Even if the accident was partially your fault, you can still bring a claim. The accident being partially your fault is not an automatic bar to recovery. Instead, most states have laws known as comparative fault. This means if there’s any portion of fault that’s applied to you, then any recovery or verdict you receive would be reduced accordingly. So, for example, if you were found to be just 10% at fault for an accident, you can still bring a claim. But any award that you get would simply be reduced by that 10%.
