Hernia Mesh Injury Lawsuits

When an organ, intestine, or fatty tissue squeezes through a hole or weak spot in the surrounding muscle or connective tissue, it is known as a hernia. Each year, more than 1 million hernia repair surgeries are performed across the United States. Over 80% of these procedures are performed to repair hernias in the inner groin, also known as inguinal hernias. To support weakened tissue following the procedure and prevent hernias from recurring, many doctors insert the surgical mesh. Over time, research has linked certain medical devices like mesh to negative side effects. To speak with a hernia mesh lawyer about injuries you or a loved one sustained following hernia surgery, call Nahon, Saharovich & Trotz. We are a large personal injury law firm dedicated to helping injured clients and providing them with personal and individual care throughout the legal process.

What Is Hernia Mesh?

Hernias are common in the abdomen, groin, and upper thigh areas of the body. Hernia repair surgery entails sewing the hole closed, and use of mesh can be effective in terms of hernia repair and prevention as it is used as a patch to support weakened tissue. Surgical mesh is a medical device that is typically either synthetic or made from animal tissue. While mesh made from animal tissue is typically absorbable, synthetic mesh can be absorbable, non-absorbable, or a combination. Non-absorbable mesh is permanent and intended to provide support for longer periods of time.

A popular form of surgical hernia mesh is Physiomesh, which is manufactured by Ethicon, a subsidiary of Johnson & Johnson. In May 2016, Ethicon voluntarily recalled Physiomesh, noting “recurrence/reoperation rates…were higher than the average rates of the comparator set of meshes among patients.” Another form of mesh linked to medical problems is C-QUR, manufactured by Atrium Medical.

Surgical Hernia Mesh Can Cause Adverse Side Effects

Surgical hernia meshes like Physiomesh and C-QUR have been linked to many of the negative side effects listed below. If you have experienced any of these hernia mesh complications following hernia surgery, consult with a doctor immediately. Depending on the facts of your particular situation, financial recovery may be available. Our hernia mesh lawyers can advise you.

  • Pain
  • Infection
  • Internal bleeding
  • Hernia recurrence
  • Mesh migration
  • Perforated organs
  • Perforated tissues
  • Bowel obstruction
  • Adhesion (when tissues stick together)

Pursuing Compensation for Injuries Caused by Unsafe Medical Devices

Across the United States, lawsuits have been filed against Ethicon, Johnson & Johnson, Atrium, and other manufacturers alleging their products were defectively designed and manufactured, leading to unintended injuries after being used in a reasonably foreseeable manner. The companies have also been accused of failing to warn patients of potential risks and adverse side effects, according to claimants and their hernia mesh attorneys.

Similar to product liability cases, damages in a hernia mesh lawsuit can include medical bills, lost wages, pain and suffering, emotional distress, loss of enjoyment of life, and loss of consortium. These elements of damages are typically compensated for as compensatory damages. Punitive damages, on the other hand, are a separate class of damages that can be obtained in a medical device case. These are awarded as punishment against a large corporation, typically for acts like knowingly hiding risks, purposely failing to warn patients and doctors, and deliberately skirting FDA regulations.
