NST Law Reports Some Nursing Homes Endanger the Welfare of Patients by Trying to Maximize Profits and Revenues

Thursday, June 9th, 2011

According to the New York Times, as a nursing home’s profit increases, the overall welfare of its patients tends to decrease.  A current trend in Tennessee and across the country is for large private equity firms and investment companies to purchase nursing home chains as investments.  In order to maximize their investments, owners become concerned about a nursing home’s financials and bottom line.  One way these firms maximize profit is by reducing costs.  Unfortunately, some nursing homes cut staff, shrink the budget for supplies, and fail to fix structural problems with their facilities.  Sometimes, nursing homes even cut staff to levels below the legal limit.  Regulators maintain that patients in these types of nursing homes suffer.  The Centers for Medicaid and Medicare Services reported that at nursing homes owned by private investment companies, residents generally experience more depression, loss of mobility, and loss of ability to bathe and clothe compared to residents of other homes.  In addition, nursing homes owned by investment firms typically score lower than average in categories used to rate the quality of nursing homes.  For example, data from a study conducted by the Centers for Medicare and Medicaid Services indicates the number of residents per registered nurse is 7 residents higher in investor-owned homes.  In addition, instances of quality of care deficiencies, such as moldy food and mixed up medications, were 19 percent higher in investor-owned homes.  Corporate owners concerned about financials end up telling the experienced nursing home administrators and managers how to run the home.

Woman Sues Nursing Home for Negligence as Reported By Tennessee Nursing Home Abuse Attorneys at NST Law

Thursday, June 9th, 2011

According to the Richmond Register, a woman is suing Madison Manor nursing home in Kentucky for negligence.  The woman is the widow of a former Madison Manor patient.  The woman claims the nursing home failed to treat an infection on her now-deceased husband’s foot while he resided at the home, which led to leg amputation and then death.  The lawsuit claims the negligent care at the nursing home quickened the deterioration of her husband’s health beyond the natural aging process.  The lawsuit also claims the facility was negligent by failing to maintain adequate staffing, keep sufficient records, and treat and monitor symptoms and pain. The defendants of the lawsuit include the corporation that owns Madison Manor and Madison Manor’s administrator.  The defendants are accused of negligence, corporate negligence, medical negligence, and violating long-term care residents’ rights.
