Memphis City Officials Introduce Plan to Increase Pedestrian Safety

Friday, October 7th, 2011

According to the Memphis Commercial Appeal, the city of Memphis, Tennessee, plans to increase pedestrian safety on Central Avenue near the University of Memphis campus. The effort is part of a $3.3 million dollar safety improvement project. City officials recognize the dangers of a campus that is “separated from the main student parking lot by a busy five-lane street.” Since 1995, two pedestrians have been killed and a third was severely injured in motor vehicle accidents on Central Avenue near campus. This project includes constructing a new median, creating a new parking lot entrance, and closing the fence between the parking lot and Central Avenue to push foot traffic towards safer crosswalks.

The Tennessee auto accident attorneys at Nahon, Saharovich, and Trotz (“NST Law”) applaud initiatives aimed at increasing pedestrian safety. Pedestrians in high-traffic areas, such as a college campus, face the risk of being hit by a moving car and sustaining permanent injuries. Corey B. Trotz, an auto accident attorney at NST Law, understands how to pursue maximum compensation for pedestrian accident victims. Since joining NST Law over twenty years ago, Corey B. Trotz has represented victims with serious and catastrophic injuries, including paraplegia, quadriplegia, brain trauma, and spinal cord damage. If you or a loved one has been injured in a pedestrian accident, call Corey B. Trotz at 901-683-7000 or 1-800-LAW-4004 for a free initial consultation on your case.

Corey B. Trotz and fellow NST lawyers have extensive experience developing the damages portion of personal injury claims. An accident victim may face complex and expensive medical costs following the crash, including an overnight stay at a hospital, surgeries, and CT scans. Victims may also require future medical care, including physical therapy. NST Law can retain medical experts to document medical bills and project the medical care a victim could later need. Next, an accident may force a victim to miss work or render her unable to adequately perform her position. To prove these damages, NST Law can consult with a vocational economist who can document a victim’s lost wages and compute her diminished earning capacity. Finally, pedestrian accidents can cause emotional stress and anguish. To prove the extent of a victim’s pain and suffering, NST Law can retain psychologists and other similarly trained experts.

According to WMC Memphis, a motorist crashed into two horses with riders in Madison County, Tennessee, on May 31, 2011. Investigators say a truck was traveling north on Diamond Cove Road when it hit a horse ridden by a 21-year-old male and 12-year-old girl.  The truck then hit the second horse, ridden by a 20-year-old male.  The 12-year-old girl was thrown from the horse and pronounced dead at Jackson-Madison County General Hospital.  The other riders were treated for minor injuries at the hospital.  Immediately after the crash, the driver of the truck removed his license plate from his vehicle and drove away.  Police are currently searching for the driver of the truck.

Memphis, Tennessee Ranked Seventh Most Dangerous City for Pedestrians According to Study

Tuesday, May 24th, 2011

According to the Commercial Appeal, of the 54 largest metro areas in the United States, Memphis, Tennessee, was named the seventh most dangerous for pedestrians and walkers in a recent study released by Transportation for America in May 2011.  From 2000-2009, 266 pedestrians were killed in Memphis.  The study says that adding sidewalks and bike lanes, shortening crossing distances, and installing crosswalks are measures for increasing protection for pedestrians that cities should look into.

Although Memphis’ ranking in this study improved from fifth most dangerous in 2009, it is clear Memphis has room for more improvement.  During the warmer summer months, the number of pedestrians on Memphis and Shelby County streets such as Poplar Avenue increases.  More Memphians walk to work and walk for exercise.  As the number of pedestrians increases, it is important for drivers to be aware of and exercise caution around pedestrians.  If you or a loved one has been injured in a pedestrian accident with a vehicle, call the Memphis pedestrian accident attorneys at Nahon, Saharovich, and Trotz (“NST Law”) at 901-683-7000 or 1-800-LAW-4004 for legal advice.  If a negligent driver caused your accident, you may be entitled to recover compensation for your injuries. To prove another driver’s negligence, NST Law can review the accident report, speak to witnesses, or speak to police officers that were at the scene of the crash.  NST lawyers also have knowledge of Tennessee driving and insurance laws and can apply them to the unique facts of your case to file a claim on your behalf.

For the damages portion of a claim, NST lawyers fight for clients to obtain maximum compensation for medical bills, pain and suffering, permanent disability and lost wages.  NST lawyers may consult with doctors and specialists who can determine and prove the crash caused a pedestrian victim’s injuries or death. NST lawyers have years of experience interpreting medical data and speaking with medical experts.  NST lawyers can also retain medical and economic experts to document current and future medical bills, such as surgeries, physical therapy, CT scans, X-rays, and other medical procedures.  If a pedestrian accident forces a victim to miss work or affects a victim’s ability to fully perform his or her job, NST lawyers can retain a vocational economist to compute lost wages and future diminished earning potential.  Since lost wages and medical bills can be burdensome and stressful, NST lawyers fight for victims to recover damages for the pain and suffering they experience as a result of the crash.

Lawyers In Tennessee, Arkansas and Mississippi Help Pedestrians Injured In Accidents With Cars

Monday, March 14th, 2011

Accidents between cars and pedestrians occur every day and can result in catastrophic and deadly injuries.  In Maryland, a jury recently awarded 3.3 million dollars ($3,300,000.00) to surviving relatives of a woman who was killed by moving car.  The deceased was walking on a part of a road with no sidewalks or guardrails when a car veered onto the shoulder and hit her. The jury found the state of Maryland liable for the woman’s death, and damages were awarded to the deceased woman’s daughter and mother.

In Tennessee, the law requires drivers to give pedestrians the right of way when they are crossing a street within a marked or unmarked crosswalk at an intersection.  If a pedestrian crosses at any place other than a crosswalk, he or she must yield to drivers, but drivers still have the responsibility of exercising reasonable care.  According to Tennessee law, drivers must exercise due care to pedestrians at all times when operating a vehicle.

If you have been hit by a car on Poplar Avenue or any other street in Memphis, Germantown, Millington, Frayser, or Shelby County, call the lawyers at Nahon, Saharovich, and Trotz today at (901) 683-7000. Tennessee Pedestrian Accidents Causing Serious Injury

Monday, April 12th, 2010

Most people cross streets, walk to the market or through a store parking lot on a daily basis.  We cross the street on our way to work while our children cross the street on their way to school.  Rarely do we consider that there is a real chance that we may be involved in a pedestrian accident.  Nonetheless, the statistics regarding the frequency of pedestrian accidents is staggering. At Nahon Saharovich & Trotz, PLC (“NST Law), we employ the latest cutting edge technology in litigating pedestrian accident cases.  When a pedestrian is involved in a pedestrian accident, the resulting injuries are frequently catastrophic or life threatening because the human body does not typically fair well when it is faced with the impact of thousands of pounds of metal in the form of a car, truck or SUV.

The statistics concerning the frequency and seriousness of pedestrian accidents is mind-boggling.  Over 68,000 people are injured and another 5,000 killed in pedestrian accidents each year.  Consider a few more statistics that give a more complete picture of the risk of being seriously injured or killed in a pedestrian accident:

  • 180,000 pedestrians were killed in motor vehicle accidents between 1975-2005.
  • A pedestrian is injured in a motor vehicle accident every 8 minutes and killed every 111 minutes.
  • There are approximately 69,000 pedestrian accidents per year.

A pedestrian who is injured or killed in a motor vehicle accident may seek compensation against any person or entity whose negligent conduct contributed to the accident.  Potential parties that may be liable include any drivers at fault or a governmental agency, such as, municipal, state or federal agencies responsible for the design, construction and maintenance of the sidewalk, roadway or parking lot.  Other drivers owe a duty to exercise “reasonable care under the circumstances” when driving a motor vehicle, while governmental agencies owe a duty of reasonable care in the safe design and maintenance of sidewalks, roadways and parking lots.  Common causes for pedestrian accidents include the following:

  • Inattentive or preoccupied drivers
  • Driver’s failure to obey the speed limit
  • A driver’s failure to yield at a crosswalk
  • Disregarding traffic signs and signals
  • Failure to signal when turning
  • Ignoring weather or traffic conditions
  • Driving while under the influence of drugs or alcohol

The sad reality is that if a pedestrian is involved in a pedestrian accident the probability of serious injury or death is very high. A pedestrian involved in a motor vehicle accident has an 85% chance of death when a car is traveling over 40 mile per hour.  Pedestrian accidents also commonly result in catastrophic injuries like brain injuries, spinal cord and head/neck injuries.  These types of pedestrian accident injuries affect the quality of life of the person injured sometimes for the rest of his or her life.  These types of injuries will typically require ongoing medical treatment and rehabilitative therapy with the injured victim never fully recovering from his or her injuries.  Catastrophic injuries of this kind also mean a great deal of medical cost and rehabilitative care not to mention the lost earnings from time off work.

At NST Law, we have handled many pedestrian accidents and know that the lawyers for a driver or the driver’s insurance company will routinely allege that the pedestrian who was injured or killed was at least partially responsible for his own injuries.  Unfortunately, if the defendant’s attorneys are successful in establishing that a pedestrian did not act in a reasonably prudent manner for his own safety, a judge or jury may reduce a pedestrian’s recovery in proportion to the percentage of fault attributable to him or her.

The attorneys of NST Law will aggressively oppose attempts by defense lawyers to establish you should be apportioned fault in the accident that resulted in your injuries.  We may use state of the art computer animations and the testimony of accident reconstruction experts to help establish that your were not partially responsible for the accident or to mitigate your proportion of fault.

There are commons types of conduct by pedestrian’s that the attorney of a driver or the driver’s insurance frequently point to as evidence of a pedestrian’s own negligence.  At NST Law, we have a great deal of experience addressing claims that a pedestrian’s recovery should be reduced and a degree of fault allocated to the injured pedestrian.  Types of pedestrian conduct often used as examples of pedestrian negligence include the following:

  • Ignoring traffic controls: This would include entering a crosswalk against a “don’t walk” signal or yellow light.

  • Jaywalking: If a pedestrian crosses the street in an inappropriate or unexpected location (i.e. the middle of the block), a pedestrian puts himself or herself at a greater risk of injury.

  • “Darting” Children/Parents: Children often run out into the street without looking to chase a toy or pet.  Alarmed parents will sometimes hastily follow to rescue a child and fail to check for traffic.

  • Walking on a limited access highway: This is an extremely dangerous but sometime unavoidable practice when a driver has car trouble.  Generally, a pedestrian is well advised to stay off any roadway marked “No Pedestrians.”  Drivers on these roadways are driving at high rates of speeds and are not typically expecting pedestrians.

The presence of any of these types of conducts greatly complicates recovery in a pedestrian accident.  The experienced pedestrian accident lawyers at NST Law can evaluate your case and present you with potential strategies and outcomes if any of these types of conducts are present in your pedestrian accident case.  Super Lawyers have recognized several attorneys at NST Law, which rates the top 5% of lawyers in the country.  We at NST Law understand the potentially life altering consequences when you or someone you love is involved in a pedestrian accident; we pride ourselves on using the latest technology as well as novel and innovative strategies in litigating pedestrian accident cases.
