Dyersburg Tennessee Teen Drives Jeep Into Crowd of People

Monday, April 11th, 2011

According to the Dyersburg State Gazette, a Dyersburg High School student has been charged with attempted first-degree murder and leaving the scene of an accident for driving his Jeep into a crowd of people in the school parking lot.  The incident occurred after a baseball game between Dyersburg High School and Crockett County High School on April 7, 2011.  Right after the game, fans and spectators got into a shouting match, congregating in the parking lot. The Dyersburg student, leaving the school in his car, hit a 16-year-old Crockett County student and ran him over. A witness said the driver revved his engine and “went past the parking lot a little bit. He was gunning it still. He slowed down a little bit. Two girls jumped out [of the car] and he just kept going.”  The witness said the victim did not see the car coming.  After the incident, the driver left the scene of the crash and was later found by police near his home.  The victim was transported to the Regional Medical Center (The Med) in Memphis and is currently in critical condition.  In this accident, it is important to determine whether or not the actions of the driver were intentional, because insurance coverage may not apply if the driver meant to cause harm.

Jury Awards 16 Million Dollars to Pedestrian Hit By Car

Thursday, March 31st, 2011

According to ABC News Sacramento, a California jury recently awarded 16 million dollars ($16,000,000.00) to a 25-year-old woman struck by a car.  Four years ago, the victim was hit by a car when jogging through a crosswalk.  The jogger, then performing her medical residency at UC Davis Medical Center, suffered brain damage and permanent disability.  At trial, city planners, including a former mayor of Sacramento, testified the crosswalk was unsafe.  The jury ultimately felt the city of Sacramento was negligent in creating an unsafe environment for walkers and joggers and believed the city knew the area was dangerous.  Since this accident, the city has changed traffic from two-way to one-way and installed a pedestrian-activated signal light.

Lawyers In Tennessee, Arkansas and Mississippi Help Pedestrians Injured In Accidents With Cars

Monday, March 14th, 2011

Accidents between cars and pedestrians occur every day and can result in catastrophic and deadly injuries.  In Maryland, a jury recently awarded 3.3 million dollars ($3,300,000.00) to surviving relatives of a woman who was killed by moving car.  The deceased was walking on a part of a road with no sidewalks or guardrails when a car veered onto the shoulder and hit her. The jury found the state of Maryland liable for the woman’s death, and damages were awarded to the deceased woman’s daughter and mother.

In Tennessee, the law requires drivers to give pedestrians the right of way when they are crossing a street within a marked or unmarked crosswalk at an intersection.  If a pedestrian crosses at any place other than a crosswalk, he or she must yield to drivers, but drivers still have the responsibility of exercising reasonable care.  According to Tennessee law, drivers must exercise due care to pedestrians at all times when operating a vehicle.
