According to the Associated Press, an East Tennessee man was charged with driving under the influence (“DUI”) after crashing into two bicyclists in Newport, Tennessee, on July 12, 2011. One bicyclist died in the crash and the other suffered minor injuries. The Tennessee Highway Patrol accident report stated the driver had been drinking alcohol prior to causing the crash. Police say additional charges may be filed against the driver.
Bicycle accidents can produce devastating results. A rider’s helmet and protective gear may not protect him from the impact of a moving car or truck. It is not unusual for a bicycle accident to permanently disable a cyclist or even kill a cyclist. If you have lost a loved one in a bicycle accident in Tennessee, call the Memphis bicycle accident attorneys at Nahon, Saharovich, and Trotz at 901-683-7000 or 1-800-LAW-4004 today for a free initial consultation on your case. Nahon, Saharovich, and Trotz, also known as NST Law, has handled bicycle crash cases for over two decades and knows how to fight for family members to recover maximum compensation for medical bills, lost wages, and pain and suffering stemming from losing a loved one in a bicycle accident.
One way a driver can be negligent is by driving under the influence of alcohol. NST lawyers can prove negligence by retaining a toxicologist to administer and interpret a drug test. When a Team NST lawyer can prove another driver’s negligence, a client is more likely to recover maximum damages in a bicycle accident case. For the damages portion of a claim, NST lawyers fight for clients to obtain maximum compensation for medical bills, pain and suffering, and lost wages. NST lawyers may consult with doctors and medical specialists who can determine and prove the crash caused a bicyclist’s death. NST lawyers have years of experience interpreting medical data and speaking with medical experts. NST lawyers can also retain medical and economic experts to document medical bills incurred by the deceased, such as surgeries, CT scans, and X-rays. NST lawyers can retain a vocational economist to compute future lost wages. Since lost wages and medical bills can be burdensome and stressful, NST lawyers can fight for families to recover damages for the pain and suffering they experience as a result of the crash. NST Law can determine the extent of one’s mental pain and anguish by retaining the services of psychiatric experts and doctors.

According to USA Today, many states are enacting laws that protect the interests of bicyclists. Since 2000, the number of bicyclists on roads has increased greatly. From 2000-2009, the number of adults who commute to work has increased 44%, according to the Census Bureau. United States Secretary of Transportation Ray LaHood said that over the last 20 years, “walking and biking trips have more than doubled as more people look for opportunities to leave the car at home, reduce their impact on the environment and stay in shape.” Tennessee, in particular, has passed a three-foot passing law and created new traffic offenses for motorists, failing to exercise due care when passing a bicyclist and failing to yield to pedestrians in crosswalks.

April 17, 2011 – According to WSMV Nashville, many Tennessee bicyclists believe the state of Tennessee does not sufficiently protect bicyclists that have been hit by motor vehicles. One cyclist even said that drivers who crash into bicyclists in Tennessee are treated no differently than if they were to run into animals on the side of the road. Much of the outrage stems from a February 2011 accident in Middle Tennessee when a bicyclist almost died after being hit by a dump truck. The truck driver was ultimately cleared of all charges, including a $50 fine for driving within 3 feet of a cyclist, after a Tennessee Department of Safety investigation. Recently, the Tennessee Transportation Committee responded to calls from concerned cyclists by passing a bill that would impose a $250 fine against a driver for the unsafe passing of a pedestrian or cyclist. Tennessee cyclists continue to seek change and feel it is time for their interests to be better protected.
If a negligent driver causes a car accident that injures other drivers or passengers, the victims may recover damages for injuries or losses under Tennessee law. If a negligent driver crashes into a bicyclist, that cyclist can suffer many of the same types of injuries as an injured driver or passenger. At Nahon, Saharovich, and Trotz (“NST Law”), our Tennessee personal injury lawyers are committed to helping bicyclists recover damages for injuries sustained after being hit by a car or truck on Poplar Avenue, Germantown Road, Union Avenue, or other Memphis or Tennessee roads. Your NST lawyer will aggressively fight for you to receive the compensation you deserve, such as damages for medical bills, lost wages, permanent disability, and pain and suffering. Your NST lawyer will first try to reach a fair settlement with the driver’s insurance company, but if a reasonable deal cannot be reached, your NST lawyer will be prepared to file a lawsuit and fight for you in court. Do not hesitate to call NST today at (901) 683-7000 or 1-800-LAW-4004 if you have been hit by a car or truck while riding your bicycle.
