Woman Awarded $9 Million Against 3 Doctors as Reported by Tennessee Medical Malpractice Attorneys at NST Law

Thursday, April 21st, 2011

According to the Associated Press, a San Miguel County jury recently awarded a woman 9 million dollars ($9,000,000.00) against 3 doctors it found to be negligent in handling her medical treatment in 2006.  The woman suffered heart damage after a heart attack went over one day without being diagnosed. In 2006, the victim came to an emergency room with symptoms that included crushing chest pain.  The victim claimed one of the physician defendants, an emergency room doctor, abandoned her to see other patients who were not as ill, and by the time the victim was transferred to another hospital, her heart attack symptoms had changed.  The victim also spent time at a third hospital.  The victim claimed the other two physicians were negligent because they failed to adequately follow up with the victim after conducting various tests to ensure she knew the seriousness of lab reports that indicated a potentially life threatening condition. According to the victim’s attorney, the victim will likely need a heart transplant because of the severe heart damage she suffered.  Her medical costs are expected to be 5 million dollars ($5,000,000.00).

Healthcare providers and medical professionals are held to a high standard, and those that deviate from that standard can be liable for medical malpractice.  Medical malpractice refers to professional negligence of a doctor, physician, or other medical professional.  Medical malpractice can include a failure to diagnose, a misdiagnosis, an emergency room mistake, a surgical mistake, and other acts of negligence and recklessness that do not conform to standards of the medical community.  If you have been injured by the conduct of a medical professional, doctor, nurse, hospital, or medical clinic, call the Tennessee medical malpractice attorneys at Nahon, Saharovich, and Trotz (“NST Law”) at (901) 683-7000 or 1-800-LAW-4004.

NST Law has the experience, knowledge, and resources to handle a medical malpractice case. First, a Tennessee medical malpractice lawsuit must be filed before the statute of limitations expires, meaning if a victim fails to file a claim in a timely manner, he or she will be permanently barred from doing so.  NST Law understands these procedural requirements for a medical malpractice case in Tennessee.  NST also has the resources to determine if medical malpractice has occurred.  For example, NST lawyers can obtain the opinion of a medical expert to determine if a doctor or nurse deviated from the required standard of care and that the deviation caused the victim’s injury or medical condition.  NST Law also utilizes these experts and others to aggressively seek damages for medical bills, pain and suffering, and lost wages on behalf of our clients.  NST can retain vocational economists to document lost wages and project future diminished earning capacity.  NST can also consult with economic experts to document current and future medical expenses that a victim will require.  In the case of a permanent injury, NST Law can commission a day-in-the-life video that illustrates how a condition affects a client’s daily life.

Nahon, Saharovich, and Trotz is the largest plaintiff’s personal injury law firm in Tennessee dedicated to protecting the rights of victims of medical malpractice in Memphis, Jackson, Knoxville, and surrounding Tennessee counties.  At NST, we aggressively fight for our clients to recover every dollar they are legally entitled to.  To speak with one of our , call Nahon, Saharovich, and Trotz at (901) 683-7000 or 1-800-LAW-4004.

Tennessee Man Dies After Accident with Tractor Trailer On Highway 58 in Kingston TN

Wednesday, April 20th, 2011

According to WBIR Knoxville, a 78-year-old man died in Kingston, Tennessee, after he drove underneath a tractor-trailer on April 19, 2011.  That night, the deceased was traveling south on Highway 58 in a Chevrolet when a tractor-trailer pulled out of a nearby parking lot.  The tractor-trailer, also heading southbound on Highway 58, crossed both southbound traffic lanes and into the path of the deceased’s car.  The deceased then drove under the trailer and died as a result.

Parking lots are often located in areas frequently traveled by vehicles.  Therefore, it is extremely important for tractor-trailer truck drivers to exercise caution when pulling out of parking lots in order to avoid colliding with a smaller private-passenger vehicle.  If you have lost a loved one in a trucking accident in Tennessee, call the Tennessee trucking accident attorneys at Nahon, Saharovich, and Trotz at (901) 683-7000 or 1-800-LAW-4004 for a free consultation on your case.  Nahon, Saharovich, and Trotz, also known as NST Law, has represented trucking accident victims in Tennessee for over twenty years, handling cases involving accidents on Interstate 40, Interstate 240, Interstate 55, and Interstate 24.  Trucking accident cases can be complex because big rig and commercial truck drivers are often subject to Tennessee and federal safety regulations. For example, Federal Motor Carrier Safety Regulations (FMCSR) mandate safety requirements when operating these types of vehicles, such as limiting the maximum number of hours that a person can drive a tractor-trailer on the road and prohibiting the use of alcohol or drugs by a driver while on duty. At NST Law, our trucking accident lawyers are familiar with these regulations and can consult with experts to determine if a truck driver violated any regulations at the time of the crash.  NST lawyers also begin investigating a trucking accident as soon as possible.  NST Law may retain investigators to document evidence from the scene of the accident or reconstruction specialists to recreate the accident.  Combining knowledge of Tennessee trucking laws with the use of experts allows NST lawyers to prove negligence, helping clients recover maximum compensation.

Fatal trucking accidents can also come with medical bills, lost wages, and pain and suffering, costs that can be passed on to surviving family members and loved ones.  NST lawyers can retain medical experts to prove a victim’s cause of death, economic experts to document medical bills, and vocational economists to compute lost wages.  NST lawyers utilize these resources to fight for clients to obtain every dollar they are legally entitled to.

Nahon, Saharovich, and Trotz is the largest plaintiff’s personal injury law firm in Tennessee dedicated to protecting the rights of trucking accident victims in Tennessee.  NST Law has offices in Memphis, Jackson, and Knoxville and handles trucking accident cases throughout Tennessee.  To speak to a Tennessee Tractor Trailer Truck Accident Attorney, call the attorneys at Nahon, Saharovich, and Trotz today at (901) 683-7000 or 1-800-LAW-4004.

Tennessee Bicyclists Seek Protection from Negligent Drivers

Sunday, April 17th, 2011

April 17, 2011 – According to WSMV Nashville, many Tennessee bicyclists believe the state of Tennessee does not sufficiently protect bicyclists that have been hit by motor vehicles. One cyclist even said that drivers who crash into bicyclists in Tennessee are treated no differently than if they were to run into animals on the side of the road.  Much of the outrage stems from a February 2011 accident in Middle Tennessee when a bicyclist almost died after being hit by a dump truck.  The truck driver was ultimately cleared of all charges, including a $50 fine for driving within 3 feet of a cyclist, after a Tennessee Department of Safety investigation. Recently, the Tennessee Transportation Committee responded to calls from concerned cyclists by passing a bill that would impose a $250 fine against a driver for the unsafe passing of a pedestrian or cyclist.  Tennessee cyclists continue to seek change and feel it is time for their interests to be better protected.

If a negligent driver causes a car accident that injures other drivers or passengers, the victims may recover damages for injuries or losses under Tennessee law.  If a negligent driver crashes into a bicyclist, that cyclist can suffer many of the same types of injuries as an injured driver or passenger. At Nahon, Saharovich, and Trotz (“NST Law”), our Tennessee personal injury lawyers are committed to helping bicyclists recover damages for injuries sustained after being hit by a car or truck on Poplar Avenue, Germantown Road, Union Avenue, or other Memphis or Tennessee roads.  Your NST lawyer will aggressively fight for you to receive the compensation you deserve, such as damages for medical bills, lost wages, permanent disability, and pain and suffering.  Your NST lawyer will first try to reach a fair settlement with the driver’s insurance company, but if a reasonable deal cannot be reached, your NST lawyer will be prepared to file a lawsuit and fight for you in court.  Do not hesitate to call NST today at (901) 683-7000 or 1-800-LAW-4004 if you have been hit by a car or truck while riding your bicycle.

NST Law is the largest plaintiff’s law firm in Tennessee that pursues maximum compensation for persons hit by cars or trucks in Tennessee and has offices in Memphis, Jackson, and Knoxville. Pickup Truck Strikes Man in Wheelchair Crossing Tennessee Street

Sunday, April 17th, 2011

According to ABC News Nashville, a man in a wheelchair was taken to the hospital after being struck by a pickup truck at the intersection of Murfreesboro Road and Plus Park Boulevard in Nashville on the morning of April 13, 2011.  According to witnesses, a pickup truck heading inbound on Murfreesboro Road was stopped at the red light at Plus Park Boulevard.  When the light turned green, the truck accelerated forward and hit the victim, who was still in the process of crossing Murfreesboro Road.  The victim was thrown off his wheelchair and landed 10 feet away from it.  The victim was rushed to a nearby hospital but did not appear to suffer life-threatening injuries.  Police said the driver would be charged with undue care, driving without a license, and driving without insurance.

It is important for drivers to pay attention to pedestrians at intersections and crosswalks because the impact from a crash between a motor vehicle and a person can cause serious injuries, such as brain trauma, spinal cord damage, paraplegia, or quadriplegia.  If you or a loved one has been hit by a car or truck in Memphis, Jackson, Knoxville, or surrounding counties in Tennessee, call Nahon, Saharovich, and Trotz at (901) 683-7000 or 1-800-LAW-4004 today.  At Nahon, Saharovich, and Trotz, our 28 car accident lawyers know how to prove a driver’s negligence to help clients recover maximum compensation for their injuries.  For example, our Tennessee crosswalk accident attorneys have experience speaking with law enforcement officers and accident witnesses to determine the cause of an accident.  If the cause has not yet been determined, NST lawyers can retain an accident reconstruction expert to recreate the accident.  In addition, NST lawyers can interpret accident reports and apply Tennessee driving and insurance laws to the unique facts of a car wreck.

For the damages portion of a claim, NST Law’s goal is to help clients obtain maximum compensation for medical bills, pain and suffering, lost wages, and permanent disability.  To accomplish this goal, NST lawyers can retain various experts to document past medical bills, compute lost wages, and project diminished future earning capacity.  NST lawyers can also commission a day-in-the-life video, demonstrating how injuries affect a client’s daily life and ability to perform routine tasks.  In the event the driver did not have insurance, NST Law will utilize its knowledge of Tennessee insurance laws to file an Uninsured Motorist claim for maximum compensation.

To speak to a Tennessee car wreck attorney, call Nahon, Saharovich, and Trotz at (901) 683-7000 or 1-800-LAW-4004.  NST Law has represented pedestrians hit by cars and trucks in Tennessee for over twenty years and has experience handling cases involving many types of injuries.  It is never too early to begin investigating a car accident, so call NST Law today for a free consultation on your case.

Arrests Made in Tennessee High Speed Police Chase as Reported by Auto Accident Lawyers at Nahon, Saharovich, and Trotz.

Thursday, April 14th, 2011

According to the Cleveland Daily Banner, a 45-year-old man and 41-year-old woman were arrested for leading police on a high-speed chase down Interstate 75 in Bradley County, Tennessee, in March 2011. Initially, Bradley County sheriffs spotted a pickup truck that had been reported as stolen driving on Interstate 75.  The 45-year-old man was driving the truck, and the sheriffs followed in pursuit. On I-75, the man swerved in and out of traffic to avoid the officers.  He then exited I-75 at Paul Huff Road, hitting four private passenger vehicles in the process.  As he turned from Paul Huff Road onto Georgetown Road, he struck two more vehicles, causing him to lose control of the truck and enter the yard of a private residence.  Law enforcement arrested the suspects. The driver faces many charges, including reckless driving and reckless endangerment.  Paramedics assisted at the scene, but it is not known if anyone was seriously injured.
